1. Definitions

These terms of agreement apply to:
1.1. Museumshop Den Haag: Museumshop Den Haag, Lange Voorhout 58b 2514 EG Den Haag.
1.2. Client: buyer of goods, being a natural person not acting beyond the practice of an occupation or operation of a business.

2. Applicability

2.1. These terms and conditions apply, to all offers, orders and agreements of Museumshop Den Haag, unless otherwise agreed.
2.2 The acceptance of an offer or placing of an order means that you accept the applicability of these terms.

3. Offers/ agreements

3.1.All offers by Museumshop Den Haag are non-committal, unless expressly provided otherwise by Museumshop Den Haag. All offers are considered as invitations to make an offer.
3.2. An agreement only becomes effective when Museumshop Den Haag has accepted your order. Such confirmation is not an acceptance of an offer, but is to inform the client that the order is received by Museumshop Den Haag.
3.3. The agreement will be realized at the moment Museumshop Den Haag has accepted the offer and has sent and confirmed this by means of a second email (confirmation of sending).The agreement will thus be realized at the moment Museumshop Den Haag has sent this confirmation.
3.4. The agreement text is stored by Museumshop Den Haag. Irrespective of the confirmation of sending, this saved agreement text is only accessible to the client when the client can show a special interest in a new transfer.
3.5. Museumshop Den Haag cannot be held responsible for entries with obviously incorrect prices, for example due to obvious system or input errors.
3.6. The goods sold are exclusively offered in small amounts (household quantity) to legally adult persons.
3.7. Museumshop Den Haag is entitled to refuse orders without statement of reason.

4. Withdrawal

4.1. If, for whatever reason, you do not wish to keep an article after all, you may return the article to Museumshop Den Haag and dissolve the agreement as long as this is within fourteen (14) working days of its delivery. In such a case, returns will only be accepted if the article's packaging is undamaged and the plastic seal has not been broken. You will be responsible for the direct costs of returning the article.
4.2. You can withdraw your order within a sighting period of 14 days after receipt of your order. This period starts with the notification of the withdrawal, only after products are delivered to the client.The client can exercise the right to withdrawal by sending a letter of cancellation (by letter, fax or email) within the set term, or by returning the delivered products to Museumshop Den Haag within set term.The date of post registration will be the date of entry.
4.3. Upon expiry of the said term, the articles shall be deemed to have been accepted definitively by the client.
4.4. The client can either exercise the right to withdrawal by sending a letter of cancellation by email to (info@museumshopdenhaag.nl) or send it by mail to:

4.5. If it is clear that an article does not comply with the agreement, it should be returned to Museumshop Den Haag. If delivered goods show material or manufacturing defects, which include transport damage, then the client must report this immediately – in any event within 14 days after delivery - in writing to customer service.
4.6. Exercising the right to withdrawal shall not apply to products specified to the different requirements of clients.
Consequences of withdrawal
4.7. In the event of valid cancellation, payments already paid and possible use shall be offset against each other. The client will then provide to Museumshop Den Haag the correct banking details. If the client cannot – or only partly- return the article(s) or the use of it, the client shall compensate for the value of the damaged article(s). This shall not apply if the deterioration of the goods is exclusively the result of their inspection, as would be the case upon inspection within shop premises, for instance. Return of the goods must be in original packaging (including accessories and documentation).
4.8. You will be responsible for the direct costs of returning the article.
4.9. Goods must be returned to the warehouse in original packaging, including the return form:

4.10. In case of prepayments, Museumshop Den Haag shall repay within 30 days the amount of the purchase including the shipping costs to the client.

5. Warranty

5.1. All that has been agreed relating to warranty of articles is without prejudice to the rights and claims that the law grants to clients.
5.2. The warranty becomes null and void if third parties make changes or repair delivered goods, if any damage occurs as a result of the improper use of article(s), if the article(s) are inadequately maintains or in case of negligence.
5.3. In case of damage or defects which occur during the statutory period of warranty, the client can either choose for reparation, replacement, or reimbursement. In case of particular legal conditions, the client is entitled to compensation or reduction of the purchase amount, as well as compensation for the damage instead of compliance with/ and replacement of futile expenditures.
5.4. Warranty rights, financial compensation or reduction of purchase amount exist only if counterclaims are undisputed declared legally applicable or explicitly accepted in writing by Museumshop Den Haag.
5.5. The legal guarantee period is 2 (two) years after date of purchase.

6. Prices

6.1. The offers and prices are valid at the time the articles are ordered.
6.2. The prices for the products and services are in Euros, including VAT and excluding handling and shipping, taxes or other charges, unless otherwise stated or agreed in writing.
6.3. Shipping costs (unless mentioned otherwise) are not included in the prices stated on the website. The total price – including shipping costs - is communicated by the website of Museumshop Den Haag before the order is sent.
6.4. Shipping costs of orders within the Netherlands are included in the price. Shipping costs outside the Netherlands are 7,99 euro.
6.5. The minimum purchase value is 5 euro (excluding shipping costs).
6.6. If because of logistic of technical reasons delivery occurs in multiple shipments, shipping costs will be calculated only once.
6.7. For all orders not directly placed in the online shop but placed by mail, telephone, or written letter, regardless of the order amount, an extra amount of shipping costs will be charged (1,90 euro for orders within the Netherlands, 2,90 euro for orders outside the Netherlands).

7. Delivery and delivery time

7.1. The delivery times shown on the website are indicative. Products on stock are shipped within 7 days. You will receive your order as soon as reasonably possible and in any case within thirty (30) working days, unless you are otherwise informed by the Musuemshop Den Haag. In that case you will be informed in good time.You may then cancel the agreement without charge up to the time of delivery. Late delivery does not entitle you to damages. If delivery for any reasons suffers a delay, or if the delivery cannot be implemented, or only partially, the client will be informed about this at the latest one month after the order was placed. In this case, the client has the right to cancel the order without cost. If a payment has already been made, Museumshop Den Haag will immediately return the payment.
7.2. The stated delivery times by Museumshop Den Haag are only indicative. Accordingly, stated delivery times are in no case to be regarded as firm dates, unless otherwise agreed, explicitly and in writing. Depending on the supply situation, Museumshop Den Haag reserves the right to suspend its delivery.

8. Payment

8.1. All payment methods offered by Museumshop Den Haag are safe. The client can either choose to pay via :

iDEAL
iDEAL is a secure method of banking. During the order process, the client will be guided to the internet site of the bank and safely complete the payment in a familiar online environment. After the client has received a payment confirmation, the client can return to Museumshop Den Haag.nl and will receive an order confirmation,
iDEAL cooperates with the following Dutch banks: ABN Amro, ASN Bank, Fortis, Friesland Bank, ING, Rabobank, SNS Bank, Regio Bank, Triodos Bank and Van Lanschot Bankiers.

PayPal
PayPal is a safe and easy online payment method that does not require the client to provide creditcard data. After a paypal payment is made, the client returns to Museumshop and will receive an order confirmation.

Creditcard
For credit card payments (Visa, American Express, Mastercard and Diners Club) the client uses a credit card number, the exact name as shown on the card, an expiration date and a CVC code. The payment will be authorized online. The client immediately knows whether or not the payment was accepted. As soon as the articles are ready for shipment, Museumshop Den Haag will send invoice details to the credit card company within 2 days. In accordance with the settlement period of the client, the amount will be debited. If the payment is too late, Museumshop Den Haag retains the right to recover extra reminder costs from the client.

8.2. Payment has to be made without reduction or compensation.
8.3. In case of payment by bank credit transfer, the client is obliged to make the payment within 14 (fourteen) days after articles have been received. The date of receipt of payment is leading.
8.4. In the event that the client fails to pay an amount due on the due date of the invoice concerned, reminder costs will be charged to the client.

9. Retention of title

9.1. The ownership of products is transferred only when you have paid all you owe to Museumshop Den Haag under agreement. The risk in respect to the products is transferred at the time of delivery to you.

10. Privacy

11. Final provisions

11.1. All rights, obligations, offers, orders and agreements to which these conditions apply, including to these conditions themselves, Dutch law applies, with the exception of the rules of international law and UN-Convention with respect to the Convention on contracts for the international sale of goods (CISG).
